These Terms and Conditions (“Terms”) govern the purchase and participation in courses, camps, workshops, and educational programs offered by ThinkBuild Foundry LLC (“ThinkBuild Foundry,” “we,” “our,” or “us”). By registering for or purchasing any course, you agree to these Terms.
1. Enrollment and Acceptance
Enrollment is confirmed only after payment has been successfully processed and you receive a confirmation email.
For participants under 18 years of age, a parent or legal guardian must complete the registration and agree to these Terms on behalf of the participant.
2. Course Fees and Payment
All course fees must be paid in full before the start of the course unless a payment plan has been explicitly approved by ThinkBuild Foundry.
We reserve the right to refuse enrollment or cancel a registration if payment is not received by the stated deadline.
Prices are subject to change without notice; however, price changes will not affect registrations that have already been paid in full.
3. Refund and Cancellation Policy
Courses and Workshops
- A full refund will be issued if cancellation is requested at least 14 days before the course start date.
- A 50% refund will be issued if cancellation is requested 7–13 days before the course start date.
- No refunds will be issued for cancellations made fewer than 7 days before the course start date.
- No refunds will be issued after a course has begun.
Summer Camps
- A full refund, less a $25 administrative fee, will be issued if cancellation is requested at least 14 days before camp begins.
- No refunds will be issued within 14 days of the camp start date.
Missed Classes
No refunds, credits, or make-up sessions will be provided for missed classes unless otherwise stated.
4. Course Changes and Cancellation by ThinkBuild Foundry
We reserve the right to:
- Modify course schedules, instructors, curriculum, or locations.
- Cancel or reschedule a course due to insufficient enrollment, instructor illness, facility issues, or circumstances beyond our control.
If ThinkBuild Foundry cancels a course, participants will receive either:
- A full refund, or
- The option to transfer enrollment to a future course.
5. Student Conduct
Participants are expected to:
- Treat instructors, staff, and fellow students with respect.
- Follow all safety instructions and classroom rules.
- Use equipment responsibly.
ThinkBuild Foundry reserves the right to remove a participant from a course without refund if their behavior is disruptive, unsafe, abusive, or otherwise interferes with the learning experience of others.
6. Intellectual Property
All course materials, including presentations, handouts, videos, curriculum, software, designs, and educational content, are the intellectual property of ThinkBuild Foundry LLC.
Participants may use course materials for personal educational purposes only. Course materials may not be:
- Shared publicly,
- Copied for resale,
- Redistributed,
- Recorded and republished,
- Used to create competing educational products.
7. Photography and Media
During classes, workshops, camps, and events, ThinkBuild Foundry may take photographs or video recordings for promotional and educational purposes.
By enrolling, you grant permission for ThinkBuild Foundry to use photographs or recordings of participants unless a written opt-out request is submitted before the start of the program.
8. Assumption of Risk
Participation in robotics, engineering, programming, electronics, and maker activities involves inherent risks, including the use of tools, equipment, computers, and electrical components.
Participants and parents/guardians acknowledge these risks and voluntarily assume responsibility for participation.
9. Limitation of Liability
To the fullest extent permitted by law, ThinkBuild Foundry LLC, its owners, employees, contractors, and instructors shall not be liable for any indirect, incidental, consequential, or special damages arising from participation in any course, workshop, camp, or educational program.
Our total liability for any claim shall not exceed the amount paid for the course giving rise to the claim.
10. No Guarantee of Results
ThinkBuild Foundry provides educational instruction and learning opportunities. We do not guarantee:
- Specific academic outcomes,
- Employment opportunities,
- Competition results,
- Technical proficiency levels,
- Business or financial success.
Individual results depend on effort, participation, and many factors outside our control.
11. Technology Requirements
For online courses, participants are responsible for maintaining:
- Reliable internet access,
- Compatible devices,
- Required software and accounts.
ThinkBuild Foundry is not responsible for disruptions caused by a participant’s technology issues.
12. Privacy
Personal information collected during registration will be used for course administration, communication, and operational purposes. We will not sell participant information to third parties.
13. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the State of Texas, without regard to conflict of law principles.
14. Dispute Resolution
Before initiating legal action, both parties agree to attempt to resolve disputes through good-faith discussions.
Any legal action arising from these Terms shall be brought in a court of competent jurisdiction located in Fort Bend County, Texas.
